Word woman is often presumed as wife. mothers and sisters of husband are conveniently forgotten as far as welfare is concerned. as per the NCRB data if we take a span of 4 years from 2004-2007 nos of mothers and sisters arrested in 498a without trial on a complaint of wife were 1,23,000. As per CSR report only 2% conviction rate is found in 498a at the closure of all cases. And as per RTI 80% of the accused are released immediately after arrests as the grounds of complaint are not strong (find files attached with data).
If a huge ransom demand of one time alimony settlement is not met by the husband then mothers and sisters’ arrest are madeto pressurize the husband. The wife goes scott free and settlements are made at the cost of mothers and sisters getting arrested, charge sheeted and later parting with their property too. Many times the husbands’ family succumb to the irrational blackmailing of the daughters in law, fearing Arrest.
The courts, MP’s, Police, Mahila mandals etc justify this as an empowerment of women, but they are not realizing that these laws are not women centric but they are wife centric. One out of every 5 arrest made is that of a lady in 498a. This is just one sample but there are other IPC that too are effectively misused in disguise by wives that causes non bailable arrests of the mothers and sisters. E.g. 406 for false complaint of streedhan possession.
Hence MASHAAL (- Mothers And Sisters of Husband Against Abuse of Law) is an initiative by mothers and sister of husband who want protection as women. A failed marriage of a son/brother cannot become a dowry and criminal case, leading to their arrests and blackmail. It was coined on 6th of March 2010 as a Mumbai chapter of Women’s wing of Indian Family Foundation (IFF).
